What could go wrong.

Real estate development in any jurisdiction carries the risk of total or partial loss of capital. Risks material to this project include, without limitation: title defect or competing claim; failure or delay of subdivision, environmental or statutory approval; riparian and marine reserve constraints reducing developable area; construction cost inflation and contractor default; infrastructure servicing shortfall; slower sales absorption or lower realised pricing than underwritten; currency movement between the Kenyan shilling and the investor's base currency; changes in Kenyan land, tax or foreign ownership law; and the absence of a liquid secondary market for an interest in the project vehicle.

A full risk register, with the mitigation and residual position for each item, forms part of the data room at Stage 03. Prospective investors should take independent legal, tax and financial advice before committing capital.
